A 42-year-old man with a Middle Eastern background is charged with striking a boy at a municipal nursery in Tøyen. He is later alleged to have threatened to kill the child, breached a restraining order five times and attempted to influence a witness.
On Monday, 27 January 2025, at 15.45, a 42-year-old man entered Åkeberg nursery at Åkebergveien 23 in Oslo and struck a five-year-old boy in the face.
That is the allegation in the indictment signed on 27 May last year by police prosecutor Hedda Iversen of Oslo Police District. The act is categorised in the indictment as aggravated bodily harm – section 272 of the Penal Code – on the grounds that it was committed against «a defenceless person». The maximum penalty is six years’ imprisonment.
Two months passed. On Thursday, 27 March 2025, at 15.15, the man was back at the same nursery. This time he threatened to kill the boy, according to count II of the indictment.
Only then was the restraining order imposed.
Five breaches in five weeks
The police imposed a restraining order on the man under section 222 a of the Criminal Procedure Act, including a prohibition on entering the nursery. The indictments then set out the following:
- Wednesday, 2 April 2025: On the nursery premises.
- Wednesday, 9 April 2025: On the nursery premises.
- Saturday, 10 May 2025: At the same playground as the boy. According to the indictment, he spoke to the child and pushed him on a swing together with other children.
- Tuesday, 20 May 2025, at 11.15: On the nursery premises.
- Tuesday, 20 May 2025, at 16.20: On the nursery premises again – on the same day.
Five breaches. One of them ended with the defendant pushing the boy whom he is charged with striking and threatening to kill on a swing.
The two breaches on 20 May were not included in an indictment until 29 August, more than three months later, in a separate supplementary indictment.
«When you testify in November, you must say that you do not remember»
Then comes the part of the case that takes it from violence to something else.
On a Thursday in mid-August 2025, at around 17.00, the man, according to the public prosecutor’s supplementary indictment, approached a witness in the case inside Åkeberg nursery.
There he told her that he had spent 14 years in prison. And that when she was due to testify in November, she should say that she did not remember the part where he struck the child.
The reason he gave, according to the indictment: that it was causing problems for him and his son, and that the police were after him.
Public prosecutor Johan Strand Moldestad of the Oslo Public Prosecutor’s Office charged him in relation to the incident on 21 November 2025 – with obstruction of justice, section 157 of the Penal Code, and with reckless conduct, section 266. The maximum penalty under section 157 is six years’ imprisonment.
The prosecuting authority has stated that section 79(a) of the Penal Code will apply. The provision applies when an offender has committed several offences and the sentence is determined collectively. In such cases, the term of imprisonment may be increased by up to twice the maximum.
The case begins next week in Oslo District Court.
