The Supreme Court ruled in Trump’s favour that mail-in ballots may be sent only to US citizens. Twenty-three Democratic states want to send out mail-in ballots as they did in 2020, when all and sundry received them. Mail-in ballots are crucial to the Democrats’ chances of winning.
‘Several Federal laws, including 18 U.S.C. 1015 and 611, prohibit foreign nationals from registering to vote or voting in Federal elections. Yet States fail adequately to vet voters’ citizenship, and, in recent years, the Department of Justice has failed to prioritize and devote sufficient resources for enforcement of these provisions,’ the executive order states.
The Supreme Court voted 6–3 to lift the temporary injunction against Trump’s executive order on more restrictive use of mail-in ballots, which the 23 Democratic-controlled states had persuaded a judge to impose.
Initially, the ruling paves the way for the US Postal Service to check the mailing of mail-in ballots against a list of citizens maintained by the Department of Homeland Security. But it is also a significant political victory for the Trump administration, which has opposed the widespread use of mail-in voting, citing what it considers an increased risk of manipulation and electoral fraud.
The recent election of a new mayor of Los Angeles was decided by mail-in ballots. Spencer Pratt was doing well until the mail-in ballots began pouring in. Then Cynthia Raman came away with the votes. Mail-in ballots also mean that the election drags on for weeks.
Trump recently criticised what he called a suspiciously high number of mail-in ballots cast for Cynthia Raman in the 2026 Los Angeles mayoral primary.
‘You know, they don’t have a voting booth; it’s all by mail. I don’t think a Republican can win in California unless they pass the Save America Act,’ Trump told Fox News, referring to the Republicans’ bill to restrict the extent of mail-in voting and introduce voter-ID requirements.
‘They have to get rid of mail-in voting.’
The Supreme Court minority consisted of the liberal justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson.
